General Terms and Conditions
§ 1 Scope of application
These terms and conditions govern the legal relationship between Kronberg Academy Foundation and persons purchasing concert tickets or articles. They are an integral part of the contract for the purchase of tickets and items from our store. By purchasing an admission ticket to Kronberg Academy Foundation events or an item from the Kronberg Academy Foundation store, the ticket purchaser recognizes the following terms and conditions as binding.
§ 2 Programs and starting times
The current programs and starting times are announced in the Kronberg Academy Foundation's publications.Please also note our notices at the venues.We reserve the right to make changes to the line-up and program for important reasons, insofar as these are reasonable. In particular, we reserve the right to make changes to the line-up if artists are unable to perform because they are ill or cannot attend the event for other reasons. In this case, care will be taken to ensure that an equivalent or at least approximately equivalent musician in terms of reputation and qualifications is substituted. We reserve the right to make changes to the program, particularly in the event that a program item cannot be performed and a change is therefore absolutely necessary. Here too, care will be taken to ensure that the program change does not lead to a significant change in content.
§ 3 Ticket prices/article prices
The ticket prices will be announced in the publications of Kronberg Academy Foundation and at Eventim.A service fee of €3 is charged per order.The price also includes the respective statutory VAT, if applicable.The prices of our articles can be found in our store next to the respective article and include the statutory VAT.
§ 4 Discounts
Pupils, students (up to 27 years), trainees and young people in voluntary services (FSJ, FÖJ, BFD) (up to 27 years) as well as severely disabled persons from 80% (GdB) receive a 50% discount on the ticket price in advance and at the box office upon presentation of appropriate proof. The concert ticket is only valid in combination with the discount card and must be presented at the entrance without being asked. Tickets purchased at full price cannot be subsequently reduced. The discount does not apply to the events Classic for Kids, Masters in Performance, public rehearsals and master classes or other selected events. Remaining tickets will be sold at the box office one hour before the start of the event.Reserved tickets must be collected and paid for at least half an hour before the start of the event, otherwise they will be returned to public sale.
§ 6 Tickets for public rehearsals and master classes
Visitor tickets are valid for attending a teaching unit consisting of two consecutive rehearsals or master classes. Please note that in some venues there are only a limited number of seats available. Please be there about 15 minutes before the start of the lesson. We ask for your understanding that entry and exit are only possible during a break in the lesson. Pupils, students, trainees and young people in voluntary services (FSJ, FÖJ, BFD) receive visitor tickets free of charge after prior booking.
§ 7 Gift vouchers
Gift vouchers of 30 euros, 50 euros, 70 euros or 100 euros can be ordered online via the Kronberg Academy Foundation webshop or from the ticket office. Vouchers for any amount can be purchased in our ticket office. Vouchers that are used for an event must first be exchanged for concert tickets.
§ 8 Payments and shipping costs
Payments for concert tickets or articles can be made by direct debit or credit card (Visa, Mastercard), stating the full address. Cash payments can also be made at the box office. The dispatch of ordered tickets is free of charge with the TicketDirect (dispatch of tickets as an e-mail attachment for self-printing) or MobileTicket (dispatch of tickets to the mobile device) dispatch methods.There is a service fee of €3 per order. (see § 3)
§ 9 Exchange and return of cards
In principle, there is no entitlement to the return or exchange of tickets. Subsequent changes to an order are not possible after the contract has been concluded. There is no entitlement to return or exchange tickets for unattended events. For admission tickets, § 312g paragraph 2 number 9 of the German Civil Code (BGB) applies – the right of withdrawal is excluded.
Changes to the cast and program do not entitle the holder to exchange or return tickets. If an event already in progress has to be canceled, no replacement can be granted. If an event is canceled for good cause before the start of the event, the ticket price will be refunded. The right to a refund of the ticket price must be asserted at the advance booking office where the tickets were purchased. A period of eight weeks must be observed, beginning on the day of the canceled event. After expiry of this period, the ticket price minus all fees such as advance booking, system or processing fees will be refunded by Kronberg Academy Foundation/Eventim within a further period of four weeks.
After expiry of this period, the claim for reimbursement expires. Further claims against the Kronberg Academy Foundation are excluded.
§ 10 Loss of tickets
Kronberg Academy Foundation will not provide any compensation for the loss of tickets.
§ 11 Passing on admission tickets and data collection
The public and commercial resale of admission tickets is not permitted. This does not apply to purchasers whose statutes provide for the passing on or brokering of tickets to members or other groups of persons.
§ 12 Late admission
There is no entitlement to admission after the start of the event. Late admission can only be granted during a break in the event. In this case, the instructions of the staff must be followed.
§ 13 Premature termination of the event
An event that is held up to a scheduled break and cannot be continued thereafter for an important reason for which the organizer is not responsible shall be regarded as a fully completed event and shall not entitle the organizer to any claims for compensation. However, this shall only apply in the event that at least half of the event time has elapsed by the time of the break. An important reason exists in particular if there are hazards within the premises (e.g. fire alarm) or if musicians are unable to perform for health reasons.
§ 14 Liability
Unless the organizer is compulsorily liable for personal injury, financial loss and damage to property on the basis of statutory provisions, liability for such damage is excluded. Liability is limited to damages caused by intent or gross negligence.Kronberg Academy Foundation shall also not be liable in the event of force majeure and coincidence or for defects that cannot be detected immediately even if the usual care is exercised.
§ 15 Image and sound recordings
By purchasing an admission ticket, the visitor agrees that the organizer may create, reproduce and publish images of the visitor as a participant in the event in print and audiovisual media. This consent is granted free of charge and is unrestricted in terms of time and space. The creation of audio, photo, film and video recordings by the visitor is prohibited.
§ 16 House rules
By purchasing tickets for Kronberg Academy Foundation events, the ticket purchaser acknowledges Kronberg Academy Foundation's domiciliary rights and the house and hall rules as binding. The valid admission ticket must always be shown to the house staff on request. It is not permitted to take a seat other than the one indicated on the ticket. It is not permitted to consume food and drink brought into the venue. The measures taken and instructions given by staff in the interests of safety, order and cleanliness must be complied with. The staff authorized by the management to do so shall exercise domiciliary rights within the venue. They are authorized to expel visitors who endanger safety, peace and order, disturb other visitors, violate the provisions of the General Terms and Conditions or do not follow the instructions of the staff. The purchase price will not be refunded in such cases.
§ 17 Data protection
By purchasing a ticket, the visitor agrees to the storage of his/her personal data. Kronberg Academy Foundation processes personal data in compliance with the data protection provisions applicable to the contract. The data (e.g. name, address, e-mail, telephone number, etc.) is collected, stored, processed and used to the extent necessary for the establishment, structuring or amendment of the contractual relationship, for example for the personal support of Kronberg Academy Foundation guests, for sending information and in accordance with the data protection regulations. The data will not be passed on to third parties. Consent can be revoked at any time.
§ 18 Cancellation policy - Right of withdrawal
In accordance with Section 312g (2) sentence 9 BGB, you have no right of withdrawal and no right of return when purchasing tickets. If you purchase tickets as a consumer in our online store www.kronbergacademy.de, by telephone in our ticket office or by post, you have the right to withdraw from this contract within 14 days without giving reasons. The withdrawal period begins on the day on which you or a third party named by you take possession of the goods. To exercise your right of withdrawal, you must inform Kronberg Academy Foundation (Beethovenplatz 1, 61476 Kronberg), fax 06173-783379 or e-mail karten@kronbergacademy.de by means of a clear statement (letter, fax or e-mail) of your decision to withdraw from this contract. To comply with the revocation period, it is sufficient for you to send the notification of the exercise of the right of revocation before the expiry of the revocation period.
§ 19 Consequences of withdrawal from the purchase of gift vouchers
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within 14 days from the day on which we receive notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will we charge you any fees for this repayment.
The gift voucher in question will be canceled by Kronberg Academy Foundation immediately after the effective exercise of the right of withdrawal.
§ 20 Place of jurisdiction, applicable law
The place of jurisdiction for all disputes arising from or in connection with a ticket pre-sale transaction between Kronberg Academy Foundation and a customer is Königstein im Taunus. German law also applies to ticket sales and purchases from our store sent to a country other than the Federal Republic of Germany (international legal transaction). The place of jurisdiction for disputes arising from such sales transactions is Königstein im Taunus.
§ 21 Severability clause
In the event that provisions of these General Terms and Conditions should be invalid in whole or in part, this shall not affect the validity of the remaining provisions. An ineffective clause or partial clause shall be replaced by a provision that comes closest to the content of the ineffective provision.
